This Agreement (the "Agreement") is a legal agreement between you and Blue Mountain Coffee India (the sole owner of its brand "Blue Mountain Coffee India" and https://www.yagachi.coffee) that states the terms and conditions under which you may receive the Blue Mountain Coffee India Service and use the Blue Mountain Coffee India Website (https://www.yagachi.coffee). If you use the Blue Mountain Coffee India Service or https://www.yagachi.coffee, you agree to these terms and conditions. Blue Mountain Coffee India and https://www.yagachi.coffee is hereinafter referred to as https://www.yagachi.coffee.

https://www.yagachi.coffee Service is a service available to authorised users ("customers") who access https://www.yagachi.coffee. Blue Mountain Coffee India currently provides an online coffee shopping and delivery service, and may in the future provide additional shopping and related services.

https://www.yagachi.coffee's employees, agents or designees will deliver orders for coffee available on https://www.yagachi.coffee. Delivery may be free of charge or as per the mentioned rates and made to the delivery address that you specify when you confirm your order.

Prices for products you place in your cart will be guaranteed for the transaction. Payment for coffee is due at the time of transaction. You are responsible for ensuring that someone is present at the delivery address to receive deliveries at the specified time. Anyone at the delivery address who receives the delivery is conclusively presumed to be authorised to receive. If https://www.yagachi.coffee cannot deliver your order, or must make an additional delivery because no one is at the delivery address to receive and pay for the order at the specified time, or wrong address/details given to us by you, an additional fee will be assessed. If you are not satisfied for any reason with an item purchased through the https://www.yagachi.coffee Service, you may call customer service at the time of receiving your order at +91 96117 99001 or write to us at support@bluemountaincoffee.co.in. https://www.yagachi.coffee's liability for missing a delivery is limited to delivery at a later agreed time at no additional charge.

PRICING

All the products listed on https://www.yagachi.coffee will be sold at the price stated on the Website. Although prices of the coffee do not fluctuate on a daily basis, they are subject to change depending on various factors. Revised prices will be updated almost immediately on the portal.

CANCELLATION POLICY

As a policy you will not be able to cancel any order after it is placed on the Website, but you may email us at support@bluemountaincoffee.co.in within 6 hours of it being ordered for us to cancel/refund the same. However, if there are changes in the delivery address or a need to add more products, you need to call us on customer care number +91 96117 99001.

Once the cancellation is done, the amount (entire amount or any deduction such as service charges) will be refunded via the original method of payment within 15 to 20 working days.

RETURN POLICY

If a customer receives a damaged or poor quality product and it comes to the notice of Blue Mountain Coffee India by mail or call, we will replace the damaged product with a new one or refund the amount to the customer.

REFUND POLICY

If a client is charged twice for one transaction, the duplicate transaction amount will be refunded via the same source within 15 to 20 working days.

REPLACEMENT POLICY

If the return policy is applicable, please confirm with us within 7 working days to review the damaged product, and we will arrange a replacement within 4–7 working days.

DELIVERY / SHIPPING POLICY

We use the best and reputed courier services or India Post to despatch our products within a day or two of receiving the order. Delivery takes 3–5 working days and may vary depending on the location.

PLEASE NOTE

If we suspect any fraudulent transaction by any customer or any transaction which defies the terms & conditions of using the Website, we at our sole discretion may cancel such orders. We will maintain a negative list of all fraudulent transactions and customers and would deny access to them or cancel any orders placed by them. Please note we have a 'no return and refund policy'.

PROPERTY RIGHTS

"Blue Mountain Coffee India", https://www.yagachi.coffee, all Blue Mountain Coffee India logos, and all titles, characters, names, graphics and button icons are service marks, trademarks and/or trade dress of Blue Mountain Coffee India and may not be used by you for any reason other than as expressly permitted by this Agreement. All other trademarks, service marks, product names and company names or logos appearing on https://www.yagachi.coffee are the property of their respective owners.

YOUR ACCOUNT

You agree to provide Blue Mountain Coffee India with accurate and complete information as required by registration for the Blue Mountain Coffee India Service ("Customer Registration Data"), including, but not limited to, your name, billing and delivery addresses, telephone number, and to promptly notify Blue Mountain Coffee India of any change in your Customer Registration Data. Upon registration, your username and password will allow you to access the Blue Mountain Coffee India Service. Your password should be kept strictly confidential to prevent unauthorised use. You agree to notify Blue Mountain Coffee India promptly of any unauthorised use of your password or your account. If Blue Mountain Coffee India makes material changes to this Agreement, Blue Mountain Coffee India will provide notice to you in a manner provided in this Agreement. Your use of the Blue Mountain Coffee India Service after any such change will be conclusively deemed acceptance of such change. Blue Mountain Coffee India may discontinue or revise any or all aspects of the Blue Mountain Coffee India Service without prior notice to you. Price and availability of products are also subject to change without notice.

ARBITRATION

The place of arbitration shall be Chennai. The Arbitration & Conciliation Act, 1996, shall govern the arbitration proceedings. The arbitration proceedings shall be in the English language.

APPLICABLE LAW
